Terms and Conditions of Use
Policies.
We are happy to meet with you in person at our office in Asbury Park, NJ. Travel to your location will require an additional fee for time and travel expenses.
If you are contracting an ecommerce site, Billings design is not responsible for input of products. Data entry can be arranged at an additional fee. For informational sites, any content, images, copy or text must be submitted in electronic form. We require all materials (pictures, graphics, logos, copy / text, etc) up front before starting work. We will not be responsible for spelling errors, incorrect or missing materials turned over by client. Exact text given will be used; please confirm what you hand over is finalized, spell checked, and complete.
We are dedicated to providing you with top quality service. However, if a client choses to terminate a business relationship with Billings Design, credit, (if any), will be issued at our discression.
Service Contract.
As a client of Billings Design, I have agreed to retain the services of Billings Design and one or more if its representatives and hereby agree to strictly adhere to the following guidelines:
A. The client is entitled to a written estimate on an individual project at the time of the initial consultation, which will include both the time necessary to complete such project and the cost with such project. However, this is not a bid for the project. Should a client's work require more time to complete than initially estimated, the client will be advised prior to the time initally estimated for completion.
B.,The client will be given a copy of this service contract on or prior to commencement of any projects. Multiple projects require multiple service contracts to be signed, regardless of weather such projects are for the benefit of a single client.
C. The normal hourly rate for any project is negotiable. Rush jobs may be subject to higher rates. Flat Rates may be negotiated by either our Sales Director, Ann DiStefano, or Billings Design's owner, Lauren Billings. Any work in addition to that described in writing as part of the initial estimate will be charged at an hourly rate in addition to any price already negotiated, which rate may be higher than that which was previously negotiated.
D. In rare circumstances, a flat rate may be set for projects requiring an extensive amount of work to complete.
E. If a flat rate will be used on a client's work, this price will be set at the initial consultation. The client will also be responsible for purchasing any and all materials and/or additional necessary materials (stock photography, hosting, etc) at the time of final payment.
F. All goods and services must be paid for upon receipt of the itemized bill. Credit is not offered. Payments may be made in the form of cash, money order, Visa/Mastercard or by Business Check. No personal checks will be accepted.
G. All clients will receive an itemized bill when the project is complete.
H. The client hereby agrees to pay the bill in full upon completion of the project. I. Billings Design will provide all services as it is exactly dictated by the client. If there are changes to be made to a project after the work is complete, the client will be billed hourly for the revisions. If direction is not made clear by the client, Billings Design will assume the right to make decisions on layout and design in its reasonable discression.
J. Finished projects will not be delivered until final payment is made in full to Billings Design.
K. Deposit of 1/3, or 33% is required prior to starting work. Balance due upon completion. By submitting payment to a Billings Design Representative, I fully agree, as a client of billings Design, to adhere to the foregoing terms. Failure to comply with these rules may result in termination of the service contract with payment in full immediately due and payable to Billings Design for all hours incurred, including reimbursement for cost of any materials purchased in connection with this project. This Service Contract shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and assigns, but neither Billings Design nor the client shall be entitled to assign or delegate any of their respective rights or duties hereunder without first obtaining the express prior written consent of the other party. This Service Contract may be executed in any number of counterparts, each of which shall be deemed an original, and all of which taken together shall be deemed to constitute one and the same instrument. This Service Contract shall become effective immediately upon its execution by the parties hereto. The client's consent to any modification shall not be unreasonably withheld. This Service Contract and all disputes arising hereunder shall be governed by the internal laws of the State of New Jersey, without regard to conflicts of laws principles.
